   1. Reggae Products (“the company”) provides the information contained on www.reggaeproducts.co.za (“the website”) and advertises and sells the products to you (“the customer”).
   2. The website enables you to shop online for an extensive range of goods including [Cosmetics & Industrial and Domestic cleaning products] and more (“Goods”).
   3. These Terms and Conditions govern the ordering, sale and delivery of our goods, and the use of the website.
2. ACCEPTANCE
   1. Only registered users may order goods on the website.
   2. If you do not agree to the terms and conditions contained herein, you should cease using the website forthwith, as further use will automatically bind you to these Terms and Conditions.
3. REGISTRATION AND USE OF THE WEBSITE
   1. These Terms and Conditions are binding and enforceable against every person that accesses or uses this website, including without limitation each user who registers (“registered user”). By using the website and registering on the website, as may be applicable, you acknowledge that you have read and agree to be bound by these Terms and Conditions.
   2. To register as a user, you must provide a unique username and password and provide certain information and personal details to Reggae Products. You will need to use your unique username and password to access the website in order to purchase Goods.

4. AMENDMENTS TO THESE TERMS AND CONDITIONS
   1. Reggae Products may, in its sole discretion, amend/alter or vary any of these Terms and Conditions at any time. It is your responsibility to regularly review these Terms and Conditions and make sure that you are satisfied with the changes. Should you not be satisfied, you must not place any further orders on, or in any other way use, the website.
5. CONTENT OF THE WEBSITE
   1. Whilst every effort is made to update the information provided on this website on a regular basis, Reggae Products cc and the website makes no representations or warranties, whether express, implied in law or residual, as to the accuracy, completeness or reliability of any information, data and/or content on the website from time to time.
   2. Reggae Products and the website reserves the right at any time to change or discontinue any aspect or feature of the website and any information, data and/or content on the website without notice.
   3. Reggae Products and the website may modify or discontinue from time to time, whether permanently or temporarily, any or all its services with or without any notice and shall not be liable to any party for any such modification or discontinuance of our services.
6. CONCLUSION OF SALES AND AVAILABILITY OF STOCK
   1. Registered users may place orders for Goods, which Reggae Products may accept or reject. Whether or not Reggae Products accepts an order depends on the availability of Goods, correctness of the information relating to the goods (including without limitation the price) and receipt of payment by Reggae Products for the Goods.
   2. NOTE: Reggae Products will indicate the acceptance of your order by delivering the Goods to you or allowing you to collect them, and only at that point will an agreement of sale between you and Reggae Products come into effect (the “Sale”). This is regardless of any communication from Reggae Products stating that your order or payment has been confirmed. Reggae Products will indicate the rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid.
   3. Prior to delivery or your collection of the Goods, you may cancel an order at any time provided you do so before receiving a dispatch or delivery notice. After delivery or your collection of the Goods, you may return the Goods only in accordance with the Returns Policy.
   4. Placing Goods in a Wishlist or shopping basket without completing the purchase cycle does not constitute an order for such Goods, and as such, Goods may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold Reggae Products liable if such Goods are not available or are not available at the price when you complete or attempt to complete the purchase cycle at a later stage.
   5. You acknowledge that stock of all Goods on offer is limited and that pricing is subject to change at any time without notice to you. Reggae Products will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued on the website. However, we cannot guarantee the availability of stock. When Goods are no longer available after you have placed an order, Reggae Productswill notify you and you will be entitled to a refund of any amount already paid by you for such Goods.
7. PRICING
   1. The price of each product is given on the site. The price reflected on the website is the regular retail price that Reggae Products charges for the product.
   2. When Reggae Products is having a sale or is running a promotion on specific products on site the discounted price as well as the regular retail price will be shown on the site.
   3. Every reasonable effort will be made to ensure that the regular retail price and where applicable the discounted price of all the products on Reggae Products are correct at the time of your purchase.  If the product is offered at an erroneous price, Reggae Products will not be obliged to supply the said product at the incorrect price.
8. PAYMENT
   1. Payment can be made for Goods via PayGate: Paygate processes credit card and debit card payments, in a secure SSL environment. This ensures the security of your personal and banking details.
   2. Electronic Funds Transfer: You may also choose to pay by EFT. Once payment has been made a payment confirmation must be emailed to us at sales@regchem.co.za. If you have selected to pay via this method, the following applies:
      1. the exact amount must be paid;
      2. the payment must be identified by supplying the order number and surname in the reference section on the electronic transfer;
      3. no transfers may be made from ATM’s;
      4. your order will be cancelled if the amount due is not paid within 5 business days;
      5. at the time of placing the order, the transaction details are presented to the bank and payment is collected immediately. If the bank’s authorisation is not obtained, the order will be cancelled;
      6. You may use your NAME or ORDER NO. as a payment reference.

However, our contracts dictate that these service providers may only use your information in connection with the services they perform for us and not for their own benefit;
             4. to our suppliers in order for them to liaise directly with you regarding any faulty goods you have purchased which requires their involvement.
          6. DELIVERY POLICY
             1. The following Delivery Policy is only valid for merchandise purchased via the Reggae Products website (“the website”). This policy has been developed to ensure the accurate and secure delivery of all purchases according to your delivery needs. 2. We can only deliver products to physical addresses within the borders of the Republic of South Africa.

3. Standard Deliveries will be made within 5-7 business days upon acceptance of your order.

4. Quoted delivery times are a guide only and while Reggae products endeavours to meet the targeted delivery times for standard deliveries, from time to time factors beyond our control can result in delayed delivery.

5. A unique order number will be communicated to you via email which can be used to track the status of your order.

6. Your deliveries will be made through one of our designated courier companies Kargo (https://www.kargo.co.za/) or Dawnwing (http://www.dawnwing.co.za/) for more information about their terms and conditions please visit their websites.

7. Once you have indicated your address and you have received confirmation of your order, we regret that no changes to the specified address and/or delivery option will be accepted.

8. We reserve the right to contact customers and arrange alternative delivery methods and timelines if your delivery address is remote or to cancel the order if delivery is not feasible.

9. Before you finalise your order, you have the option to indicate in the “Notes” field whether the order should only be delivered to you OR you can specify an alternative authorized person’s name to receive it on your behalf. You or the authorized person may be required to show proof of identification to the courier upon delivery.

10. In order to safeguard your purchase, the carrier will only deliver to the specified address and to you or one of the people indicated on the notes of the order as being authorised to receive your parcel.

11. The person receiving the parcel will be asked by the courier to sign the waybill indicating that the parcel/carton has been received undamaged and in good condition.

12. Proof of ID may be requested to verify authenticity of purchaser

13. In the unlikely event that the parcel/carton is damaged and/or the security seal is broken, then the receiving person can either: Accept the parcel and indicate on the waybill any damage or Refuse the parcel and indicate on the waybill why the parcel was refused. In either case the waybill should be signed by both delivery agent and customer.

14. Reggae Products reserves the right to refuse service, cancel orders and terminate accounts at the company’s discretion.

13. INTELLECTUAL PROPERTY RIGHTS

1. Copyright and all intellectual property rights in all materials, texts, drawings and data made available on this website (collectively “the materials”) are owned by Reggae Products alternatively, Reggae Products is the lawful user thereof and is protected by both South African and international     intellectual property laws. Accordingly, any unauthorized copying, reproduction, retransmission, distribution, dissemination, sale, publication, broadcast or other circulation or exploitation of such material or any component thereof will constitute an infringement of such copyright and other intellectual property rights.
2. The deeming provisions of the ECT Act are excluded to the extent that no message shall be deemed to have been received by us unless we acknowledge receipt thereof in writing. This does not detract from the fact that if the Customer submits an order more than once the Customer may have concluded a double transaction for which the Customer will be liable and that a transaction will only be deemed to have been concluded between the Customer and the Company on delivery/collection of the product.

14. LIMITATION OF LIABILITY
    1. Reggae Products cannot be held liable for any inaccurate information published on the website and/or any incorrect prices displayed on the Website, save where such liability arises from the gross negligence or wilful misconduct of Reggae Products, its employees, agents or authorised representatives. You are encouraged to contact us to report any possible malfunctions or errors.
    2. REGGAE PRODUCTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGES WHICH MIGHT ARISE FROM YOUR USE OF, OR RELIANCE UPON, THE WEBSITE OR THE CONTENT CONTAINED IN THE WEBSITE; OR YOUR INABILITY TO USE THE WEBSITE, AND/OR UNLAWFUL ACTIVITY ON THE WEBSITE AND/OR ANY LINKED THIRD-PARTY WEBSITE.
    3. YOU HEREBY INDEMNIFY REGGAE PRODUCTS AGAINST ANY LOSS, CLAIM OR DAMAGE WHICH MAY BE SUFFERED BY YOURSELF OR ANY THIRD PARTY ARISING IN ANY WAY FROM YOUR USE OF THIS WEBSITE AND/OR ANY LINKED THIRD-PARTY WEBSITE.

15. Governing law and jurisdiction.

1. These Terms and Conditions and our relationship and/or any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions.

2. In the event of any dispute arising between you and Reggae Products, you hereby consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (Local Gauteng Division, Johannesburg) notwithstanding that the quantum in the action or proceedings may otherwise fall below the monetary jurisdiction of that court.

3. Nothing in this clause 23 or the Terms and Conditions limits your right to approach any court, tribunal or forum of competent jurisdiction in terms of the CPA.
